Bounce.fm User Agreement

TL;DR (Plain English Summary)

  • Bounce has two kinds of users: Creators (artists and their teams) and Fans (listeners). One account can access both.
  • You own your music and must have the rights to upload it.
  • Bounce hosts your files so you can collaborate — we don't take ownership.
  • We won't use your music to train AI without your explicit permission.
  • Your music is private by default. If you choose to make your artist page public, anyone on the internet (including search engines) can see it and stream the songs you publish, including through Bounce Lounge.
  • If you're in a band, the band's page can show your name and photo when it's public — you can hide yourself in settings.
  • Fans can follow artists and can choose to share their email with an artist for release news. Artists must use those emails responsibly.
  • Fans get a personal, non-commercial license to stream (and, where the artist allows it, download) published music — nothing more.
  • Bounce is for human-created music, not purely AI-generated tracks.
  • Pricing is based on songs and projects, not using Bounce as a file dump.
  • Paid plans renew automatically until you cancel; you can manage or cancel in the app anytime.
  • Abuse of storage, fake accounts, scraping, or bad behavior can result in suspension or termination.
  • If you choose to monetize through Bounce, you'll sign a separate agreement.
  • Disputes are resolved by individual binding arbitration, not in court and not as a class action (with a small-claims exception and a 30-day opt-out — see Section 22).
  • Always keep your own backups — Bounce is not a backup service.

1. Introduction

Welcome to Bounce.fm! This Agreement is presented to you when you create an account. By creating an account or otherwise accessing or using our platform, you agree to comply with and be bound by this User Agreement ("Agreement"), including the binding arbitration and class-action waiver in Section 22. If you do not agree, you may not use Bounce.fm.

2. Definitions

  • "Bounce.fm" refers to Bounce LLC, an Indiana limited liability company, and its software-as-a-service platform for music creators and listeners.
  • "User" refers to any individual or entity that accesses or uses Bounce.fm, whether or not they hold an account.
  • "Creator" (or "Artist User") refers to a User who creates, uploads, or manages Content, or who is a member of an Artist's team on the platform.
  • "Fan" (or "Listener") refers to a User who uses Bounce.fm to discover, follow, and listen to Artists. A single account may act as both a Creator and a Fan.
  • "Artist" refers to an artist, band, or project profile managed by one or more Creators on Bounce.fm.
  • "Content" means all audio, music, files, data, text, images, video, and other materials uploaded, submitted, or shared on Bounce.fm.
  • "Public Content" means Content and profile information that a Creator has elected to make publicly visible (see Section 6.5).
  • "Services" means the Bounce.fm platform, software, and related features, including public artist pages, discovery, following, and Bounce Radio.

3. Eligibility

You must be at least 18 years old to use Bounce.fm. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into this Agreement.

4. Account Registration and Account Types

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify Bounce.fm immediately of any unauthorized use.

Bounce.fm offers a single account that can operate in different modes (for example, creator tools and listening/discovery). Your account type may change based on your activity — for example, a Fan account becomes a Creator account when you join or create an Artist. This Agreement applies to your use of the Services in every mode; certain sections (e.g., Sections 5, 6, 8.2) apply primarily to Creators, and others (e.g., Sections 8.1, 12) primarily to Fans.

5. Subscription Plans, Pricing, Payments, and Storage Use

Bounce.fm may offer free and paid subscription plans, including free Fan accounts. Pricing, features, and billing terms will be disclosed on the platform or website. By selecting a paid plan, you authorize Bounce.fm to charge your payment method.

Automatic Renewal. Paid subscriptions renew automatically at the end of each billing period at the then-current price, until cancelled. You may cancel or manage your subscription at any time in the app; cancellation takes effect at the end of the current billing period, and you retain access to paid features until then. All fees are non-refundable unless required by law.

Storage Use and Abuse. Bounce.fm's pricing and plans are based on songs, projects, and platform features, not general-purpose file storage. Bounce.fm is not intended to be used as a generic cloud storage or backup service. Bounce.fm reserves the right to monitor usage for abuse, including but not limited to excessive file uploads unrelated to active music projects, use primarily for file storage, or other behavior inconsistent with normal music production workflows. If Bounce.fm determines, in its reasonable discretion, that a User is abusing high-volume file storage, Bounce.fm may suspend, limit, freeze, or terminate the User's account, and/or require the User to upgrade to a different plan, without refund. Certain plans and features may be priced or limited on a per-song, per-project, or per-work basis rather than by total storage volume.

6. User Content, Ownership, and Rights

6.1 Ownership

You retain full ownership of your Content.

6.2 Your Representations and Warranties

By uploading or sharing Content, you represent and warrant that:

  • You own or control all rights to the Content, or have obtained all necessary permissions and licenses
  • The Content does not infringe any copyright, trademark, publicity, privacy, or other third-party rights
  • You have the legal right to upload, share, and authorize Bounce.fm to host and process the Content
  • If you make Content public (Section 6.5), you own or control all rights necessary to authorize its public display, streaming, and performance to the general public worldwide, including rights in the underlying composition and sound recording, and any necessary permissions from co-writers, band members, producers, featured performers, and rights societies

6.3 License to Bounce.fm

You grant Bounce.fm a limited, worldwide, non-exclusive, royalty-free license — sublicensable only to our service providers as necessary to operate the Services — to host, store, reproduce, transmit, display, and process your Content solely as necessary to operate, maintain, and secure the Services and enable collaboration. Bounce.fm does not claim ownership of your Content.

For Content you elect to make public (Section 6.5), this license additionally includes the right to publicly display, publicly perform, stream, and distribute that Content to Users and visitors of the Services worldwide — including on public artist pages, in discovery and search features, through Bounce Radio and similar playback features, and in link previews, search-engine listings, and social-media embeds (including titles, artwork, and short descriptive metadata). This expanded license applies only while the Content remains public and ends when you make it private or delete it, except for (a) cached or preview copies held temporarily by third parties such as search engines, which Bounce.fm does not control, and (b) copies Fans lawfully downloaded while downloads were enabled (Section 12).

Bounce.fm does not pay royalties, license fees, or other compensation for the public streaming or display of Content under this Agreement. If you choose to monetize your Content through Bounce.fm, that will be governed by a separate agreement (Section 6.4).

6.4 Future Monetization

If you choose to monetize your Content through Bounce.fm, you agree to enter into a separate written monetization or distribution agreement. No monetization will occur without your explicit agreement.

6.5 Public Sharing Is Opt-In

All Artists and their Content are private by default. Content becomes public only when an authorized member of the Artist's team explicitly publishes the Artist page and selects which albums and songs to include. Making Content public means anyone — including people without Bounce accounts and search engines — can view the Artist's page and stream the published Content. You can make an Artist private again at any time, subject to the cache and download caveats in Section 6.3.

6.6 Fan License to Published Content

Bounce.fm grants Fans and visitors a limited, personal, non-exclusive, non-transferable, revocable license to stream Public Content through the Services for personal, non-commercial purposes only. Where an Artist has enabled downloads for particular Content, this license also permits downloading a copy for personal, non-commercial use. This license does not permit redistribution, re-uploading, public performance, synchronization, sampling, commercial use, resale, use of Content to train machine-learning or AI models, or any other exploitation of the Content. All rights not expressly granted are reserved by the Content owner.

6.7 Use of Content for AI Training

Bounce.fm will not use your Content — including your music, audio, stems, or project files — to train generative artificial intelligence or machine-learning models without your explicit consent. This commitment does not restrict the processing necessary to operate, maintain, and secure the Services and enable collaboration, as described in Section 6.3.

7. Public Profiles and Member Visibility

When an Artist page is public, it may display information about the Artist's team members — such as name, profile photo, username, and role — and other public Artists those members belong to. By joining or remaining a member of an Artist, you consent to this display when that Artist is public. You can hide yourself from a public Artist page, and Artist owners can disable member and related-artist display entirely, through the Artist's settings.

Public user profile pages display your name, username, profile photo, and the public Artists you belong to. Public pages may be indexed by search engines.

8. Following, Fan Data, and Artist Communications

8.1 Following (for Fans)

Fans may follow Artists to build a library and receive updates. When you follow an Artist, that Artist's team can see that you follow them, including your name. Sharing your email address with an Artist for news and marketing is a separate, optional, unchecked-by-default choice. If you opt in, the Artist may contact you about releases, events, and similar news, including outside the platform. You may withdraw this consent at any time in your settings or by unfollowing; withdrawal does not undo communications or list exports that occurred while your consent was active. See the Privacy Policy for details.

8.2 Fan Data Obligations (for Creators)

Artists may access their follower list and export contact details of Fans who have opted in to email communications. If you receive Fan personal data through the Services, you agree that you:

  • Will use it only to communicate about the Artist the Fan followed (releases, events, and similar news)
  • Will comply with all applicable laws in your use of it, including anti-spam and data-protection laws (e.g., CAN-SPAM, CASL, GDPR)
  • Will honor unsubscribe and deletion requests promptly
  • Will not sell, rent, or share Fan data with third parties, or use it for unrelated purposes
  • Are solely responsible for your use of exported Fan data; Bounce.fm is not responsible for communications you send outside the platform

Violation of this section is grounds for suspension or termination under Section 13.

9. Copyright, Infringement, and DMCA

Bounce.fm respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If Bounce.fm receives a valid copyright takedown notice, we may remove or disable access to the allegedly infringing Content.

To submit a copyright infringement notice, contact our designated agent at [DMCA agent name/address — register with the U.S. Copyright Office] or team@bounce.fm with the information required by 17 U.S.C. § 512(c)(3). If you believe Content was removed in error, you may submit a counter-notice meeting the requirements of 17 U.S.C. § 512(g) to the same address.

Repeat-Infringer Policy. Bounce.fm terminates, in appropriate circumstances, the accounts of users who are repeat infringers. An account that is the subject of three (3) valid, un-retracted copyright infringement notices will be terminated.

10. AI-Generated Content Policy

Bounce.fm is intended for human-created music. Purely AI-generated music — meaning music created entirely by automated systems without meaningful human performance, instrumentation, or vocal contribution — is not permitted. A text prompt alone does not constitute meaningful human musical contribution. Bounce.fm may remove Content that violates this policy and may suspend or terminate accounts under Section 13.

11. Acceptable Use

You agree not to:

  • Upload infringing or illegal Content, or upload malware
  • Harass, threaten, or impersonate others, including impersonating an Artist, band, or their representatives
  • Create fake, bulk, or automated accounts, or artificially inflate follows, plays, favorites, or other platform metrics
  • Scrape, crawl, or bulk-harvest content or personal data from public pages, except as permitted by standard search-engine indexing
  • Circumvent or attempt to circumvent access, visibility, or download restrictions on any Content
  • Rip, capture, or redistribute streamed Content outside the license granted in Section 6.6
  • Attempt unauthorized access, use the Services for illegal or abusive purposes, or interfere with platform operations

12. Downloads

Downloads of Public Content are disabled unless the Artist explicitly enables them for particular Content. Enabled downloads are licensed to Fans under Section 6.6 (personal, non-commercial use only). Artists may disable downloads at any time, but copies already downloaded while downloads were enabled are not retrievable by Bounce.fm.

13. Termination and Enforcement

Bounce.fm may, in its reasonable discretion, suspend or terminate your account and remove Content at any time for violations, infringement, abusive behavior, or conduct harmful to Bounce.fm or its users.

Effect of Termination. Upon termination or account deletion, your right to access and use the Services ends. Except where suspension or removal is immediate for abuse, security, or legal reasons, we will retain your Content for approximately seven (7) days after termination to allow you to export copies, after which it may be permanently removed from active systems. Because Bounce.fm is not a backup service (Section 14), you should maintain your own copies of your Content at all times.

If an Artist becomes private, is deleted, or has Content removed, related Fan features (follows, favorites, radio inclusion, and public pages) cease to reference that Content. Bounce.fm has no liability to Fans for the removal or unavailability of any Content or Artist.

14. Data Loss and Backups

Bounce.fm is not a backup service. You are responsible for maintaining your own copies of your Content. Bounce.fm is not responsible for loss or corruption of data.

15. Cookies, Analytics, and Tracking Technologies

Bounce.fm uses cookies and similar technologies to provide, operate, secure, and improve the Services — including maintaining sessions, remembering preferences, and authenticating users. Bounce.fm also uses third-party analytics and advertising-measurement services — Google Analytics (GA4), Google Ads conversion measurement, the Meta (Facebook) Pixel, and GoatCounter — to understand usage and measure the effectiveness of our own marketing. Details, choices, and opt-outs are described in our Privacy Policy.

16. Privacy Rights (GDPR & CCPA)

If you are located in the European Economic Area (EEA), United Kingdom, or California, you may have additional rights regarding your personal data, including the right to access, correct, delete, or restrict processing of your personal information, and the right to data portability.

California residents may have rights to request disclosure of categories of personal information collected, request deletion, and opt out of the "sharing" of personal information for cross-context behavioral advertising, as provided under the CCPA/CPRA. Bounce.fm does not sell personal information; for advertising-measurement pixels that may constitute "sharing," you may opt out by contacting team@bounce.fm.

To exercise your privacy rights, please contact team@bounce.fm. We may require verification of your identity before fulfilling requests. Additional details, including authorized-agent requests, are provided in our Privacy Policy.

17. Third-Party Links

Artist pages and profiles may contain links to external websites and services provided by the Artist. Bounce.fm does not control and is not responsible for the content, policies, or practices of any third-party site.

18. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind. Bounce.fm does not warrant the accuracy of any Artist or User information displayed on public pages and does not endorse any Artist or Content.

19. Limitation of Liability

To the maximum extent permitted by law, Bounce.fm shall not be liable for indirect, incidental, consequential, or special damages. Total liability shall not exceed the greater of amounts paid to Bounce.fm in the prior twelve (12) months or fifty U.S. dollars ($50).

20. Indemnification

You agree to indemnify and hold harmless Bounce.fm from third-party claims arising from your Content, your violation of this Agreement (including Section 8.2's fan-data obligations), your public sharing of Content without sufficient rights, or your infringement of third-party rights.

21. Changes to This Agreement

We may update this Agreement from time to time. For material changes, we will provide reasonable advance notice (for example, by email or in-product notice). Continued use of Bounce.fm after the effective date of an update means you accept the updated terms.

22. Dispute Resolution; Binding Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO GO TO COURT AND TO HAVE A JURY TRIAL.

a. Informal Resolution First. Before starting an arbitration, you and Bounce.fm agree to try to resolve the dispute informally. Send a written description of the dispute to team@bounce.fm; if it is not resolved within thirty (30) days, either party may begin arbitration.

b. Agreement to Arbitrate. You and Bounce.fm agree that any dispute, claim, or controversy arising out of or relating to this Agreement or the Services will be resolved by binding individual arbitration, rather than in court, except as stated in subsections (e) and (f). Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect.

c. Class Action Waiver. You and Bounce.fm agree that each may bring claims against the other only on an individual basis, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

d. Jury Trial Waiver. You and Bounce.fm waive any right to a jury trial for any dispute subject to this Section.

e. Small-Claims Exception. Either party may bring an individual claim in a small-claims court of competent jurisdiction instead of arbitration, so long as the claim remains in that court and on an individual basis.

f. Intellectual Property / Injunctive Relief. Either party may seek injunctive or other equitable relief in court to protect its intellectual property or confidential information, or to stop unauthorized access to or abuse of the Services.

g. 30-Day Opt-Out. You may opt out of this arbitration agreement (Sections 22(b)–(d)) by sending written notice to team@bounce.fm within thirty (30) days of first accepting this Agreement. If you opt out, disputes will be resolved in court under Section 23. Opting out does not affect any other part of this Agreement.

h. Seat. The arbitration will be seated in Indiana, and any in-person hearing (if required) will take place in Indiana, unless you and Bounce.fm agree otherwise or the AAA rules provide for a closer or remote hearing.

23. Governing Law and Venue

This Agreement is governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. For any dispute not subject to arbitration under Section 22 (including if the arbitration agreement is found unenforceable, or if you opt out), the state and federal courts located in Indiana will have exclusive jurisdiction and venue, and you consent to personal jurisdiction there.

24. Assignment

Bounce.fm may assign or transfer this Agreement, in whole or in part, including in connection with a merger, acquisition, financing, reorganization, or sale of assets. You may not assign or transfer this Agreement or any of your rights or obligations under it without Bounce.fm's prior written consent. Any attempted assignment in violation of this Section is void.

25. Modification or Discontinuation of the Services

Bounce.fm may modify, suspend, or discontinue the Services, or any feature or portion of them, at any time, with or without notice. Bounce.fm is not liable to you or any third party for any modification, suspension, or discontinuation of the Services, except as required by law.

26. Survival

Provisions that by their nature should survive termination will survive, including Sections 6.1–6.3 and 6.6 (ownership and license tails), 6.7, 8.2, 9, 13–14, 18–20, and 22–27.

27. Miscellaneous

  • Entire Agreement. This Agreement, together with the Privacy Policy (incorporated by reference) and any separate written agreements you enter into with Bounce.fm (such as a future monetization agreement), is the entire agreement between you and Bounce.fm regarding the Services.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
  • No Waiver. Bounce.fm's failure to enforce any provision is not a waiver of its right to do so later.
  • Headings. Section headings are for convenience only and do not affect interpretation.
